Terms of Service

The agreement

These terms govern your use of followOS Email (the "Service"), operated by follow Inc ("we", "us"). By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you use the Service on behalf of a business, you represent that you can bind that business to these terms.

What the Service is

followOS Email generates and sends email marketing — campaigns, automated flows, audiences, and creative — built from your business's website, products, and customer data, either through our own sending infrastructure or through a third-party email platform you connect. AI-generated content is produced for your review: you approve what sends, and you are responsible for what you approve.

Your list, your permission — the acceptable-use rules

You may only email people who have given you permission to email them. By importing or syncing contacts, you attest that each contact opted in to receive email from your business. The following are prohibited and grounds for immediate suspension:

  • Purchased, rented, scraped, or third-party lists of any kind
  • Sending unlawful, deceptive, or fraudulent content, or impersonating another business
  • Content that violates the CAN-SPAM Act or the laws of the recipient's jurisdiction
  • Removing or circumventing unsubscribe mechanisms or suppression lists
  • Any use that damages the deliverability, reputation, or operation of the Service

Unsubscribes and complaints are honored automatically and permanently. We may pause sending (automatically or manually) when bounce or complaint rates indicate a problem.

Your responsibilities

You are responsible for the accuracy of your business information, the legality of your products and offers in the places you sell them, maintaining the confidentiality of your account credentials, and reviewing every email before approving it to send. AI-generated content can contain errors — review before you ship.

Our rights

We may suspend or terminate accounts that violate these terms, create legal risk, or harm the Service's sending reputation. We may modify or discontinue features as the Service evolves — it is under active development, and we'll communicate material changes.

Fees

Current pricing is shown at signup or on our site. Where a paid subscription applies, it renews monthly until cancelled; you can cancel any time and retain access through the paid period. We'll give notice before any price change takes effect.

Your data

Your contact list and business data remain yours. We use them only to operate the Service, as described in the Privacy Policy. On account deletion we remove your data, subject to legal retention requirements and suppression records we must keep to honor unsubscribes.

Disclaimers

The Service is provided "as is." We do not guarantee delivery rates, inbox placement, revenue outcomes, or uninterrupted availability. To the maximum extent permitted by law, follow Inc's total liability arising from the Service is limited to the amounts you paid us in the three months before the claim, and we are not liable for indirect, incidental, or consequential damages.

Indemnity

You will defend and hold follow Inc harmless from claims arising out of your content, your contact list, your products, or your violation of these terms or applicable law.

Miscellany

These terms are governed by the laws of the State of Arizona, USA. If any provision is unenforceable, the rest remain in effect. We may update these terms; material changes will be announced to account holders by email, and continued use constitutes acceptance.
